Our Readers Write to he editor are always welcome but the names of the writers must he known to the editor G REPLIES Continued from page on the books was in fact dead Precedent would also indicate that my freedom of action should be unimpaired On the other side of Item it ft of course ridiculous to assume that the people must consulted by council with respect to passing or repealing bylaws This sim- isnt so Nor should it be It would slow the business of the town to near paralysis However did point out that a restrictive bylaw with respect to the use of land such as bylaw 616 must have an advertised public hearing before final repeal Even though town council favors its re peal the Ontario Municipal Board will only grant the repeal after the hearing it is deemed fa the public interest to do so In a democracy it is the right of citizen to appeal to the against injustice But in the enactment or repeal of municipal It is the duty of the elected to do the business of town The two questions are contradictory or related M Illustrating violations bylaw the of quoted violations of a different bylaw the towns building bylaw In doing ttiey stated I had been in- voting for a violation Of the bylaw in one case against ft another 5o be fair they should also stated that a majority of agreed with me in both eases showing commendable com mon sense We must recognize that bylaws no matter how carefully phrased arc never perfect Circumstances do alter cases The circumstances the two cases for erection of garages were different as the council after consideration RAYS cided In the one case the appli cant had gone to the building in spector and made a plea based upon the nearest possible ap proach to the requirements of the building bylaw and with the en dorsement of the building inspec tor There being no obvious public harm in compliance and since the applicant could not oth erwise erect the garage won in the centennial draw the coun cil agreed to a very minor devia tion from the bylaw In the second case the appli cant requested directly for coun cil permission for an obvious and complete fracture of the bylaw Garages are required to be built three feet from the lot line if adjacent this means 6 feet apart The proposal was for a double garage Whether this section of the bylaw is entirely sound is a debatable matter But there is no doubt that the first request was for a minor deviation and the second for deliberate break ing of the provisions of the by law Unlike the mystery writer of the Lyons letter I find a difference So did mem bers of council And so I believe will you dear readers There is also a big difference between the building bylaw and bylaw 616 The building bylaw has been regularly enforced by law 616 has been ig nored To enforce bylaw 616 now would be equivalent to en forcing the laws with respect to bathing suits current in the early Some of them are still unrepealed ITEM I did say that as a relative newcomer to Newmarket arrived four years ago I found it a nice old place which had grown up naturally and without a lot of restrictive regulations There Is nothing monotonous bout our town I also said that many modern developments closely controlled by restrictive regulations are indeed monoto nous Anyone who reads publi cations on municipal planning will find the same conclusions printed over the names of the foremost municipal planners in the land I was trying to convey the idea that the nonenforcement of by law 616 had apparently done little or no real harm If in fact it had been enforced strict ly we would have much less com mercial and industrial assessment than we now have Much of this assessment is on properties devel oped on streets named residen tial under bylaw 616 Of course the absence of this assessment would mean a higher tax rate for all the town Is this what we want Does the rest of the town want to pay higher taxes because some people but who in the Lyons Subdivision want them to For surely if we do not repeal 616 and instead en force it we will halt commercial and industrial development in the town Bylaw 616 covers nearly every street in town and makes them all residential Do you citizens want to halt commercial and in dustrial development and limit the number of jobs available in town Do want your mill rate to go steadily up Do you want to do all this just because a few people have abandoned common sense in favor of pre historic bylaws By law 616 passed in 1929 no longer has any real bearing on the situation in It should he repealed and replaced by a zoning bylaw which does proper ly apply to the situation in our town It is childish for the authors of the letter you pub lished to state that any zoning bylaw I may have anything to do with will be a lulu After all I believe I can take most of the credit for the fact that Newmarket has in the last year Prompt Service Capable Courteous Drivers Local or Long Distance Hospital Cases Our Specialty fully licensed and insured cars Dial 54311 DAY OR NIGHT WATER ST NEWMARKET formed a planning board and that this planning board is already far advanced in the development of a zoning bylaw While I am not a member of the committee which is developing this bylaw the members are serious minded citi zens who are spending a lot of time at no cost to the town on this work It is certain that they will take into account the present circum stances of the town and its ob vious present needs in framing the bylaw It is an unwarranted insult to the people on this com mittee and to myself to assume otherwise They will also no doubt con sider the way in which the town has developed I sincerely they will not forget the very plea sant and oldfashioned charm of the original heart of the town in arriving at the final zoning plan It will be no lulu to use com mon sense and try to develop a plan that considers present reali ties as well as future ambitions For will it be an error to try to avoid monotony so current in modern urban growth The Lyons letter states that this need not be the case Anybody knows that but it is painfuly obvious that it is the case only too often The major reason is too close regimenta tion of development Pardon me for believing that Newmarket wants this no more than it wants the town to be run by pressure from a few people in one of our subdivisions I believe the above letter will suffice to show that there is and was no inconsistency in my posi tion on these various maters Like a lot of other residents of this old town however I believe in the old axiom you can take a horse to water but you cant make him drink I can be convinced but it will take a lot of pushing to make me agree that a thing as long dead as should be re vived Yours truly ships close to heavily pooulated areas The problem is further ag gravated by the influx of large numbers of newcomers to Can ada who do not understand Can adian wild life or the laws pro tecting it The Conservation Club believes that items of interest brought to the attention of newspaper rea ders is the best method of in creasing the interest of alt those who enjoy the outdoors Arnold A Cedar Valley READERS WRITE 219 Millard Avenue August The Editor I wonder how many of your readers have read and under stood the comments in your re cent editorial on councillor motion to rescind ByLaw 616 I wonder more however that local administrators can approve such a ridiculous recommenda tion Newmarket has long suf fered through lack of a plan for orderly expansion and now Mr seconded by Mr Choppin would remove the last hope of control Their chief reason seems to be that the law was broken so often it might as well be taken away I presume that if the two of them were on traffic control they would remove the speed limit for the same reason It is no secret that am dis satisfied with our local govern ment and here is another why Our council members spend more valuable time picking each other to pieces for personal reasons than they apply to important Issues I trust the day is not far off when our town council will devote more time to thinking things out and less time looking at the clock Very truly C Keys Swimming Will Continue At Peter Gorman Pool If Weather CoOperates The continued use of the Peter Gorman Swimming Pool this month will depend on the weather it was announced this week by Manager Stan Smith The majority of municipal pools in the province closed on Labor Day We would like to stay open as possible said Mr Smith if we can use the pool each day so that we can afford to run the machinery it will be open to the public from to pm But if there are three or four cool days when the pool is not in use it will mean the end of swimming for this year We cant afford to operate the pool if only a half dozen swimmers are using it he explained On the other hand if we run into a spell of warm weather we shall stay open until 8 or added Mr Smith Season tick ets will be honored until the pool closes Due to a misunder standing these tickets were can celled for one day We regret any inconvenience this caused he said The Newmarket Era and Express Thursday Sept DEADLY AGGRESSIVE AND BADTEMPERED The Call For Volunteers As Forms Posse Three dangerous outlaws who have been on the loose in the area around Newmarket were seen brazenly walking along the main street of Bradford on Sat urday afternoon
